1. Introduction

Welcome to DigiWCard.

These Terms and Conditions ("Terms") govern your access to and use of the DigiWCard website, digital business card platform, mobile applications, NFC-enabled products, QR code services, and associated features (collectively referred to as the "Services").

DigiWCard is operated by Digiw Advertising & Printing, based in the Kingdom of Bahrain ("DigiWCard", "we", "us", or "our").

By registering an account, purchasing a subscription, or using our Services, you acknowledge that you have read and agree to these Terms. If you do not agree, please discontinue using our Services.

2. Our Services

DigiWCard provides digital networking and contact-sharing solutions, which may include:

Personalized digital business cards and profiles.
QR code-based contact sharing.
NFC-enabled business cards and accessories.
Contact information management.
Digital card customization and branding.
Lead collection and contact management.
Customer relationship management (CRM) features.
Third-party CRM and contact synchronization.
Google Wallet and other supported wallet integrations.
Analytics and engagement tracking.
Smart follow-up and automation features.
Subscription-based premium features.

Certain features may require a paid subscription or compatible third-party services. We may introduce, modify, suspend, or discontinue features as necessary, subject to applicable law and any contractual commitments.

3. Account Registration and Security

Users may be required to create an account to access DigiWCard services. By creating an account, you agree to:

Provide accurate and current registration information.
Maintain the confidentiality of your login credentials.
Keep your profile and contact information updated.
Notify us promptly of suspected unauthorized account access.
Accept responsibility for activities conducted through your account, except where caused by our failure to meet applicable obligations.

You must not access another user's account without authorization. We reserve the right to restrict or suspend accounts involved in fraudulent, unlawful, or abusive activities.

4. Digital Business Cards and Public Profiles

DigiWCard allows users to create and share digital business profiles through URLs, QR codes, NFC technology, and other supported methods. You acknowledge that:

Information added to a publicly accessible digital card may be viewed by anyone with access to its link or QR code.
You are responsible for ensuring the accuracy of your published information.
You must have permission to publish third-party personal information, logos, photographs, or other protected content.
Shared digital card links may be forwarded or saved by other individuals.
Information previously downloaded or saved by recipients may remain accessible outside DigiWCard even after you update or delete your profile.

DigiWCard does not guarantee that third parties will delete information they have already received.

5. NFC Cards and Physical Products

DigiWCard may offer physical NFC business cards, tags, and other networking accessories. Users acknowledge that:

NFC functionality depends on device compatibility, settings, and hardware condition.
Some smartphones may require QR code scanning instead of NFC.
Physical cards must be handled carefully to avoid damage.
Delivery schedules may vary depending on production requirements and shipping arrangements.
Custom-printed products may be subject to special cancellation and return conditions, as disclosed before purchase.

Defective products will be handled in accordance with applicable Bahrain consumer protection laws.

6. Subscription Plans and Payments

DigiWCard may provide free and paid subscription plans. The following conditions apply:

Subscription pricing, features, billing periods, and applicable taxes will be displayed before purchase.
Paid features remain available for the applicable subscription period, subject to these Terms.
Subscription renewals will occur only in accordance with the renewal conditions disclosed during purchase.
Any automatic renewal arrangement and cancellation procedure will be communicated before activation.
We may revise subscription prices with appropriate advance notice.
Failure to complete a required payment may result in restricted access to paid features.

Unless explicitly stated otherwise, subscription payments do not transfer ownership of DigiWCard software or infrastructure to users.

7. Cancellation and Refunds

Users may request subscription cancellation through available account settings or by contacting DigiWCard support.

Refund eligibility depends on the purchased service, applicable purchase conditions, and Bahrain consumer protection laws.

For digital services, refunds may be limited once the service has been activated or substantially delivered, to the extent permitted by applicable law.

For customized NFC products, cancellation may be restricted after personalized production begins, subject to statutory consumer rights.

Nothing in these Terms excludes any mandatory refund, repair, replacement, or other consumer rights under applicable law.

8. Acceptable Use

Users agree not to use DigiWCard to:

Conduct fraudulent or misleading activities.
Impersonate another person or organization.
Distribute spam or unauthorized marketing communications.
Upload malicious software or harmful code.
Publish unlawful, defamatory, or infringing content.
Collect or process personal information without an appropriate legal basis.
Attempt unauthorized access to our systems.
Interfere with platform performance or security.
Use automated tools to abuse platform resources.

We may remove prohibited content or suspend accounts when reasonably necessary to protect users, third parties, or the platform.

9. CRM Integrations and Contact Synchronization

DigiWCard may support integrations with third-party services, including Google Contacts, Microsoft Outlook, HubSpot, Salesforce, Zoho CRM, and other compatible platforms. When using these integrations:

You authorize the relevant connection and associated data exchange.
You are responsible for obtaining necessary permissions to import or synchronize contacts.
Third-party services remain governed by their respective terms and privacy policies.
Availability may depend on external APIs, account permissions, and service limitations.
DigiWCard cannot guarantee uninterrupted operation of external integrations.

Users may disconnect supported integrations through available account settings or applicable third-party authorization controls.

10. Automated Follow-Ups and Messaging

DigiWCard may provide tools for contact follow-ups, reminders, messaging workflows, and customer engagement automation.

Users are responsible for ensuring that automated communications comply with applicable privacy, electronic communications, marketing, and anti-spam requirements. Users must obtain any consent or other lawful authorization required before sending marketing messages.

DigiWCard may restrict automated messaging activities that violate applicable laws or third-party platform policies.

11. User Content and Intellectual Property

Users retain ownership of their original business information, logos, photographs, and other content uploaded to DigiWCard.

By uploading content, you grant DigiWCard a limited, non-exclusive license to host, process, reproduce, and display that content solely as necessary to provide and maintain the Services.

DigiWCard retains ownership of its software, platform design, branding, trademarks, and proprietary technology.

Users may not copy, reverse engineer, redistribute, or commercially exploit DigiWCard software except where permitted by law or expressly authorized.

12. Privacy and Data Protection

We are committed to handling personal information responsibly and in accordance with applicable data protection requirements, including Bahrain's Personal Data Protection Law (Law No. 30 of 2018), where applicable.

Personal information may be processed to provide digital business cards, manage accounts, deliver purchased services, operate authorized integrations, and support platform security.

Further information about personal data collection, processing, retention, sharing, and user rights is provided in our separate Privacy Policy. The Privacy Policy should be reviewed alongside these Terms.

13. Data Accuracy, Backup, and Availability

We aim to provide reliable and secure services. However, uninterrupted access cannot be guaranteed. Service interruptions may occur due to maintenance, software updates, hosting issues, connectivity failures, or events outside our reasonable control.

Users should maintain independent copies of important business contacts and information. We may implement reasonable security, backup, and recovery measures, but do not guarantee that every data loss event can be prevented or reversed.

14. Third-Party Links and Services

Digital business cards may contain links to external websites, social media platforms, messaging applications, payment services, and other third-party resources.

DigiWCard does not control the content, security, availability, or privacy practices of independently operated third-party services. Users access such services subject to the relevant providers' terms and policies.

15. Limitation of Liability

To the maximum extent permitted by applicable law, DigiWCard will not be responsible for indirect or consequential losses arising from use of the Services, including lost business opportunities or anticipated profits.

We do not guarantee that using DigiWCard will generate leads, sales, employment opportunities, or specific business results.

Nothing in these Terms limits liability that cannot lawfully be excluded, including mandatory consumer protection rights or liability arising from fraud or other legally non-excludable conduct.

16. Account Suspension and Termination

We may suspend or terminate access where a user:

Materially violates these Terms.
Engages in fraudulent or unlawful conduct.
Threatens platform security or other users.
Repeatedly abuses platform resources.
Fails to pay applicable subscription fees after required notice.

Where appropriate, we may provide notice and an opportunity to resolve the issue. Users may request account closure by contacting support. Account closure and associated data deletion will be handled in accordance with applicable legal obligations and our Privacy Policy.

17. Changes to These Terms

DigiWCard may update these Terms to reflect legal requirements, operational changes, security improvements, or new features. The latest version will be published on our website with a revised effective date.

Where changes materially affect users' rights or obligations, we will provide appropriate notice and obtain consent where required by law.

18. Governing Law and Disputes

These Terms are governed by the applicable laws of the Kingdom of Bahrain.

Disputes arising from these Terms will be subject to the jurisdiction of the competent courts of Bahrain, unless mandatory applicable law provides otherwise.

We encourage users to contact our support team first so that concerns may be resolved amicably.
